Frequently asked questions
How much are doc stamps on a deed in Florida?
70 cents per $100 of the sale price (or portion of $100) in every county except Miami-Dade, under section 201.02, Florida Statutes. On a $400,000 sale that is $2,800.
Why is Miami-Dade different?
Miami-Dade levies the discretionary surtax in section 201.031, so its base deed rate is 60 cents per $100. The extra 45 cents per $100 surtax applies too, unless the deed conveys only a single-family residence (a house, condo unit or qualifying co-op unit). A $500,000 vacant lot there owes $3,000 plus $2,250 surtax.
What taxes apply to a mortgage in Florida?
Two: documentary stamp tax on the note at 35 cents per $100 of the loan (section 201.08) and nonrecurring intangible tax of 2 mills, or 0.2% of the loan (section 199.133). On a $320,000 mortgage that is $1,120 plus $640.
Who pays closing taxes in Florida, buyer or seller?
By custom the seller usually pays the deed doc stamps and the buyer pays the note stamps and intangible tax, but it is negotiable. In parts of South Florida, including Miami-Dade and Broward, local custom can differ for owner's title insurance. Check your contract.
Is this my full closing cost?
No. This covers the state taxes only. Title insurance, recording fees, lender fees, prepaid interest, escrow deposits and inspections are extra.
